1. Scope and seller

These Terms of Service apply to purchases made through the MIDNIGHT SPEC DIVISION online store by consumers and business customers. The store is operated by Loris Moceri, Wassermatte 2, 8965 Berikon, Switzerland, trading under the name MIDNIGHT SPEC DIVISION. Contact: midnightspecdivision@gmail.com.

By placing an order, you agree to these Terms, subject to any mandatory rights that apply to you under the laws of your country of residence.

2. Products and descriptions

We aim to describe our products, sizes, colours and designs accurately. Colours may appear different depending on screens and manufacturing processes. Product availability, specifications and prices may change for future orders. Changes do not affect an order already accepted, except as permitted by law.

3. Made-to-order production

Our products are standard catalogue products manufactured after an order is placed by a print-on-demand fulfilment partner. Customers select from predefined sizes and colours; products are not individually personalised by customers. Production time and shipping transit time are separate. Made-to-order production does not, by itself, remove any statutory consumer withdrawal rights.

4. Prices, payment and checkout

The final price, currency, applicable taxes shown by the checkout, shipping charges and available payment methods are presented during checkout before the order is submitted. Depending on the destination and the actual checkout/tax arrangements, import duties, import VAT or customs processing fees may also arise; see Shipping & Delivery. We do not claim that all import charges are excluded or payable separately where they have already been collected at checkout. Payment is handled through the Shopify checkout and its payment providers. We do not directly receive full payment-card credentials.

5. Orders and contract formation

Submitting an order is an offer to buy the selected products. An automated order-receipt email confirms receipt but does not necessarily mean acceptance. The contract is concluded when we accept the order, no later than when we release it for production or shipment. If we cannot fulfil an order, or there is an obvious pricing error or suspected fraud, we may reject the order to the extent permitted by law and refund amounts already paid for the rejected order. Mandatory rights remain unaffected.

6. Production, delivery and customs

Available delivery destinations, shipping methods and shipping charges are shown at checkout. Any displayed delivery estimates are estimates rather than guaranteed dates, unless expressly agreed otherwise. This does not limit statutory rights relating to delayed or failed delivery. Production and shipping periods must both be considered. Import duties, taxes and fees depend on the destination and the actual tax/shipping arrangement; any charges not collected at checkout may be charged by customs authorities or carriers. See Shipping & Delivery for more information.

7. Voluntary cancellations, returns and defects

Contact us promptly if you need to change or cancel an order. We may be unable to accommodate a voluntary cancellation once production has started. This operational rule does not limit a consumer’s statutory right of withdrawal where applicable.

For goods that are damaged, defective, misprinted or incorrectly supplied, contact midnightspecdivision@gmail.com with your order number and, if available, photographs. We will assess the issue and provide the remedies required by applicable law, which may include repair, replacement, price reduction or refund as appropriate. Photographs can help us investigate but do not replace mandatory legal rights. See Returns, Withdrawal & Complaints for the full procedure.

8. Consumer withdrawal and other mandatory rights

Consumers in the European Union generally have a statutory 14-day right of withdrawal for eligible distance purchases, subject to applicable legal exceptions. The mere fact that a standard catalogue item is printed after purchase, or that the customer selected a predefined size or colour, does not automatically make it exempt. Detailed instructions, refund terms and a model withdrawal form appear in Returns, Withdrawal & Complaints.

We do not offer an additional voluntary change-of-mind return right to customers in Switzerland. This does not affect mandatory rights for defective or incorrectly delivered goods. For all destinations, mandatory consumer protections, statutory remedies and other non-excludable rights remain unaffected.

9. Business customers

Business customers are subject to the same order and delivery process unless expressly agreed otherwise. Consumer-only protections, including consumer withdrawal rights, generally do not apply to purchases made for business purposes, to the extent permitted by applicable law. Mandatory business-customer rights remain unaffected.

10. Intellectual property

Website content, designs, graphics, product photographs, logos and text are owned by the operator or used with permission from their respective rights holders. Except as permitted by law, you may not reproduce or commercially exploit this content without permission.

11. Applicable law

Swiss law governs these Terms to the extent permitted by applicable law. This choice does not deprive consumers of mandatory protections that apply under the laws of their habitual residence. Nothing in these Terms restricts mandatory consumer jurisdiction or dispute-resolution rights.

12. Contact
